Definitions

The following Terms and Conditions document is a legal agreement between Marina Technologies, hereafter “the MARINA”, and “the Client” for the purposes of website design or development and other services provide by the MARINA. These Terms and Conditions set forth the provisions under which the Client may use the services supplied.

The MARINA is an Internet web design provider offering the Client graphical design, HTML, CSS, Javascript, PHP, and other related computer programming languages. MARINA also provides Print designs, Corporate Branding and Identity, Social Media Promotions and Mobile App development.

Permission and Copyright

Copyright of the completed designs, images, pages, code and source files created by the MARINA for the project shall be with the Client upon final payment only by prior written agreement. Without agreement, ownership of designs and all code is with the MARINA.

These terms of use grant a non-exclusive limited license so that the Client can use the design on one website on one domain name only. The Client is not permitted to use a design for more than one website without prior written agreement between the Client and the MARINA.

The Client agrees that resale or distribution of the completed files is not allowed unless prior written agreement is made between the Client and the MARINA.

The Client hereby agrees that all media and content made available to the MARINA for use in the project are either owned by the Client or used with full permission of the original authors. The Client agrees to hold harmless, protect and defend the MARINA from any claim or suit that may arise as a result of using the supplied media and content.

The Client agrees that the MARINA may include development credits and links within any code the MARINA designs, builds or amends. If the MARINA designs a website for a Client, then the Client agrees that the MARINA may include a development credit and link displayed on the Client’s website.

The Client agrees that the MARINA reserves the right to include any work done for the Client in a portfolio of work. The Client agrees to abide by the terms of any third party software or media included within any work done for the Client. Examples of this include, but are not limited to, Googlemaps, Media under the Creative Commons license, RSS feeds, Open Source GPL Software etc. .

Initial work

MARINA will commence the project after getting the required materials from the Client. The home page/ mock-up/design would be shown within 5 (may vary) working days. The number of days to complete the home page/application design may vary according to the requirement of the Client. The Client needs to give a definite idea of the design/theme/colour and all aspects of the website/application/project at the time of preliminary discussion and before commencing the project. The Client can provide samples or older websites/applications as reference. The MARINA team will be creating website/application pages based on these ideas.

Content clauses

Project will commence within 24 hours after the advance payment is made by the Client. The content for the concerned website/application/project should be provided within 7 days from the time of starting the project. If the content is not provided within the 7 days, there will be an additional charge of 5% of the total project cost. The Client will be granted an extended 10 days by the MARINA to provide the content after paying the additional amount. The project is considered invalid, if the Client fails to provide the content within the extended time period. Once the project is cancelled, the payment is not refundable.

Alteration work

In case of any alterations, the changes should be informed within the first three days after the initial work has been submitted. MARINA will not undertake any further works unless confirmed by the Client at the specified time period.

Redesign Clauses

If changes are suggested by the Client after the completion and approval of the entire website/application/project, it will be considered as redesign and are chargeable. Detection of errors in contents or designs by the Client, if any, will be rectified immediately. After completion of the project, MARINA will upload the whole work in the server and the link will be sent to the Client for testing. The whole work will be uploaded in transferred/made live by MARINA, after the final approval and settlement of balance amount by the Client.

Free Maintenance

MARINA provides one year free maintenance towards all kinds of errors occurred in run time of the website/application/project. Free maintenance does not include content updation.

Quotation Validity

The quotation is valid for 7 days. Prices are subject to change without notice after the expiry of the quotation.

Material rights

Marina Technologies reserves the right to refuse to handle:

Any media that is unlawful or inappropriate.

Any media that contains a virus or hostile program.

Any media that constitutes harassment, racism, violence, obscenity, harmful intent or spamming.

Any media that constitutes a criminal offence, or infringes privacy or copyright.

Refund Policy

Our Refund Policy Has Been Devised To Define The Situations Under Marina Technologies Will Provide A Refund, The Procedure For Claiming A Refund And The Responsibility Of Marina Technologies In Circumstances Resulting In Such A Claim. By Registering For Any Of Our Services You Are Declaring That You Accept And Agree With All The Terms And Conditions Outlined In The Refund Policy. All The Information That We Collect Is Utilized For Bettering Our Web Site’s Content, To Notify The Clients About Our Website Updates Or To Look Into The Problem With Their Request. In Case You Do Not Want To Receive Any Email From Us In The Future, Please Inform Us By Writing In To Us Either Through E-Mail Or Letter.

Coverage & Scope

Our refund policy covers the refunds by Marina Technologies and/or a website owned and managed by Marina Technologies a creative IT Services in J&K India. This policy does not have any application for companies which are not owned or controlled by Marina Technologies or for persons not employed or managed by Marina Technologies.

Filing a Complaint

At Marina Technologies a creative IT Services in J&K India, we take every project with the final product in sight. It is as much our responsibility as the client’s. So, we believe that every effort should be made to reach a solution that is fully acceptable reciprocally in case of any situation where dissatisfaction related to services comes. Only when things are completely out of hand that refund should be considered.

Eligibility For Refund

At Marina Technologies Every Project Is Important To Us And We Make Sure That We Handle Each Project With Utmost Care And Professionalism. Our Aim Is To Provide The Results As Per The Terms And Conditions Of The Proposal. However, Despite Every Measure If The Client Is Not Satisfied With The Results And Chooses To Go For The Dispute Resolution Process, We Consider Refund Requests As Per The Following Program In Which Our Services And Refund Policy Related To Each Service Is Very Clearly Listed:

Website/Mobile Applications Web / Graphic design/Android/IOS Developments

Full refund:

In cases where the project has not been started or if the initial design style has not been approved. The Full Refund policy will initiate after receive the upfront payment date and will take 90 Days to refund the amount.

Partial refund:

If there is a failure to deliver as per our delivery policy after the approval of the initial design style. The partial refund will be in proportion to the work completed.

No refunds:

If the project has been completed and uploaded on the server.

Logo design / brochure design

Full refund:

In cases where the project has not been started or if the initial design style has not been approved.

Partial refund:

If there is a failure to deliver as per our delivery policy after the approval of the initial design style. The partial refund will be in proportion to the work completed.

If the project has been completed and uploaded on the server.

Web programming

Full refund:

If the project has not been initiated. There is an agreement for every web programming project. However, if there is no agreement and no clear discussion of refund policy, the following delivery policy will hold true. Partial refund will be issued as per the judgement of the service provider if we fail to complete the project in accordance with the delivery policy and contract of agreement. The amount will be calculated by Marina Technologies taking into account the proportion of the project completed and the proportion yet to be completed as per the pre-defined scope of the project. A project is not taken to be void unless the agreed upon payments are clear. Refund policy is not applicable if the required information for the successful completion of the project is not given to us at proper time. If there is delay or failure in completion of the project due to improper communication from client, it cannot be attributed to Marina Technologies. If the information provided by the client is incomplete and/or complete information regarding the project is not provided at the initiation of the project, Marina Technologies is not liable to follow its delivery or refund commitments. Even after cancellation, if client wants to continue the services as it is, Then Client has to bear the yearly renewal charges as per company policies or have to purchase the source code by providing copyright charges equivalent to the total project cost to Marina Technologies. Processing Of Refunds The Partial Refunds Will Be Processed And Mailed Within 90 Business Days Of The Date Of Cancellation And Will Be Brought About Using The Method Of Payment Agreed Upon In The Beginning Of The Project Ie; Refund By Cheque Or Refund By Credit Card. And The Full Refunds Will Be Processed And Mailed Within 45 Business Days Of The Date Of Cancellation And Will Be Brought About Using The Method Of Payment Agreed Upon In The Beginning Of The Project Ie; Refund By Cheque Or Refund By Credit Card. Changes Marina Technologies May At Any Time, Without Prior Notice Under Its Sole Discretion, Amend This Policy From Time To Time. You Are Therefore Requested To Review This Policy Periodically.
